Terms and Conditions for Use of the Webshop

1. General

These Terms and Conditions (T&C) apply to all contracts concluded between matzerath Marketing & Sales OHG (hereinafter referred to as the “Provider”) and its customers via the website. Deviating terms from the customer are not recognized unless the Provider expressly agrees to them in writing.

2. Conclusion of Contract

The product presentation in the webshop does not constitute a legally binding offer but an invitation to place an order. By submitting an order, the customer makes a binding offer. The contract is concluded only when the Provider accepts the customer's order by sending an order confirmation by email.

3. Prices and Shipping Costs

All prices are final prices in euros, including the statutory VAT unless otherwise indicated. Additional shipping costs apply, which will be clearly displayed during the ordering process.

4. Payment Terms

Payment can be made via PayPal, Amazon Pay, or bank transfer. The purchase price is due immediately and must be paid before the goods are shipped.

5. Delivery and Shipping

Shipping is carried out by our logistics partners DHL and DPD. Delivery time may vary depending on availability and delivery address. The Provider reserves the right to make partial deliveries if reasonable for the customer.

6. Right of Withdrawal

Consumers have a 14-day right of withdrawal. Further information on the right of withdrawal and a withdrawal form can be found on the Provider’s website.

7. Retention of Title

The goods remain the property of the Provider until full payment is received.

8. Warranty

Statutory warranty rights apply. In the event of defects, the customer may initially request rectification (repair or replacement). If rectification fails or is unreasonable, the customer may reduce the purchase price or withdraw from the contract.

9. Liability

The Provider is fully liable for intent and gross negligence. For slight negligence, the Provider is only liable for damages arising from injury to life, body, or health. For other damages, the Provider is only liable if a material contractual obligation has been breached, limited to typical foreseeable damages.

10. Data Protection

The Provider processes the customer’s personal data exclusively within the scope of applicable data protection laws. Further information can be found in the Provider’s privacy policy.

11. Final Provisions

If individual provisions of these T&C are invalid, the remainder of the contract shall remain valid. The statutory provisions shall replace any invalid provisions. German law applies.
