1. Scope of Application

The following terms and conditions (AGB) apply to all orders placed through our online store.

2. Contracting Party, Conclusion of Contract

The purchase contract is concluded with matzerath Marketing & Sales OHG.

By placing the products in the online shop, we make a binding offer to conclude a contract for these items. You can initially add our products to the shopping cart without any obligation and correct your entries at any time before submitting your binding order by using the correction aids provided and explained in the order process. The contract is concluded by accepting the offer through the order button, which signifies your acceptance of the goods contained in the shopping cart. Immediately after submitting the order, you will receive a confirmation by email.

3. Language of the Contract, Storage of the Contract Text

The language available for the conclusion of the contract is German.

We store the contract text and send you the order details and our terms and conditions by email. You can view the contract text in our customer login.

4. Delivery Conditions

In addition to the stated product prices, shipping costs will be added. Further information on the amount of shipping costs can be found in the offers.

We only deliver by shipping. Unfortunately, self-collection of the goods is not possible.

5. Payment

In our shop, the following payment methods are generally available:

Advance Payment: If you choose the advance payment method, we will provide you with our bank details in a separate email and deliver the goods after receipt of payment.

PayPal: During the ordering process, you will be redirected to the website of the online provider PayPal. To pay the invoice amount via PayPal, you must be registered there or register first, authenticate yourself with your access data, and confirm the payment instructions to us. After placing the order in the shop, we will request PayPal to initiate the payment transaction. The payment transaction will be carried out automatically by PayPal immediately afterward. You will receive further instructions during the ordering process.

AmazonPay: During the ordering process, you will be redirected to the website of the online provider Amazon. To pay the invoice amount via AmazonPay, you must be registered there or register first, authenticate yourself with your access data, and confirm the payment instructions to us. After placing the order in the shop, we will request AmazonPay to initiate the payment transaction. The payment transaction will be carried out automatically by AmazonPay immediately afterward. You will receive further instructions during the ordering process.

6. Retention of Title

The goods remain our property until full payment is received.

7. Transport Damages

If goods are delivered with obvious transport damages, please report such issues to the carrier immediately and contact us without delay. Failure to make a complaint or contact us will not affect your statutory rights and their enforcement, especially your warranty claims. However, it will help us assert our own claims against the carrier or transport insurance.

8. Warranty and Guarantees

Unless otherwise expressly agreed below, the statutory provisions regarding liability for defects apply. The limitation period for warranty claims for used goods is one year from the date of delivery of the goods. The above limitations and reduction of time limits do not apply to claims due to damages caused by us, our legal representatives, or vicarious agents:

• in the event of loss of life, bodily injury, or harm to health,
• in the case of intentional or grossly negligent breach of duty and fraudulent intent,
• in the case of breach of material contractual obligations, the fulfillment of which is essential for the proper execution of the contract and on the observance of which the contractual partner regularly relies (cardinal obligations),
• within the scope of a guarantee promise, if agreed, or
• to the extent that the scope of the Product Liability Act is opened.

9. Liability

We are fully liable for claims due to damages caused by us, our legal representatives, or vicarious agents:

• in the event of loss of life, bodily injury, or harm to health,
• in the case of intentional or grossly negligent breach of duty,
• in the case of guaranteed characteristics, if agreed, or
• to the extent that the scope of the Product Liability Act is opened.

In the event of a breach of material contractual obligations, the fulfillment of which is essential for the proper execution of the contract and on the observance of which the contractual partner regularly relies (cardinal obligations), caused by slight negligence on our part, our legal representatives, or vicarious agents, liability is limited in terms of the amount to the damages that were foreseeable at the time of the conclusion of the contract and typically have to be reckoned with. Otherwise, claims for damages are excluded.

10. Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR), which you can find here: https://ec.europa.eu/consumers/odr/. We are neither obliged nor willing to participate in a dispute resolution procedure before a consumer arbitration board.
